What do forms: Act № 14, Act № 15, Act № 16 mean?

These are basic instruments (Acts) issued in the course of construction and main stages which the newly constructed building in Bulgaria passes through, where the new owners can make their home.

• Act № 14 – it is issued after completion of the "rough construction" stage of the building. Act № 14 is very important because once it has been obtained the separate units in the building may be subject to deals of disposal.

• Act № 15 – it establishes that the construction of the building has been completed in full; this Act is to be signed not only by the competent officials, but by the owner of the building as well. It should be noted that once this act has been issued the site and the package of documents are to be handed over from the builder to the principal. The document contains a description of the construction contracts, construction documentation, executive documentation and the acts and protocols issued during the construction.

The construction documentation includes the construction files of the project, including the acts, records, registers, declarations of conformity of the materials used in the construction and other documents required for the issuance of the act. In addition, documentation for testing, measuring and other activity that proves that the site has been constructed in accordance with the specified technical requirements. An inventory list is to be prepared directly on the site and surrounding area in order to find any defects or unconformities in the construction, which need to be removed before obtaining a use permit. 

• Use Permit - Act № 16. It is issued after establishing the full compliance of the approved investment design. The certificate for use of fourth and fifth category buildings is issued by the municipality. Discussions are currently ongoing, whether municipalities should issue certificates to the so-called third category buildings (more than fifteen meters), now DNCS (Directorate for National Construction Supervision) deals therewith.

       The protocol certifying the building’s fitness is to be issued by certain persons appointed to the Acceptance Committee. The committee shall be appointed by the order of the principal; a report on 72-hour testing of the operating conditions is to be drawn up. This document specifies the test results upon operation of the mounted equipment, installations, devices etc., in order to evaluate the different technical parameters and study whether the measures of hygiene, fire safety etc. have been observed. This proves that the building lacks impermissible deviations.

          In case the site has passed through the above mentioned stages an "executive documentation" is to be drawn up. The builder or the person appointed as a principal will specify the nonessential deviations therein. The "executive documentation" contains the complete set of drawings for the actually completed construction and installation works. It shall be certified by the principal, the builder, the person who has performed supervision, the person who has performed construction supervision. These documents shall be submitted from the principal to the administration having issued the construction documentation and it shall certify the presented documents by a stamp affixed to all graphic and textual materials. The "executive documentation" is an integral part of the package of construction documents.
